ELLIS, J. -- The plaintiff in error, hereafter referred to as the defendant, was indicted by the grand jury of Hernando county for the murder of Robert Whitfield in May, 1915, and was brought to trial in the Circuit Court of that county in November, following, when he was convicted of lanslaughter and sentenced to imprisonment in the State prison at hard labor for a period of ten years. To that judgment the defendant took a writ of error.
